PPE, Respiratory Protection, Spills, and Exposure Reporting

Lesson 3 established that the pesticide label is the legal document that controls every application, and that the label's PPE section is enforceable under both FIFRA and Chapter 482. This final lesson is about turning the label PPE section into a working safety program — selecting the right PPE for the formulation type at hand, maintaining a respiratory protection program that holds up under FDACS or OSHA review, responding correctly when a spill or exposure happens, and keeping the records that document both routine practice and incident response. Every topic ties back to the certified operator's responsibility under Chapter 482 to operate a safe and compliant business.

PPE Selection by Formulation

The label sets the minimum, but the formulation type drives much of the practical PPE selection. The same active ingredient can ship in liquid concentrates, ready-to-use sprays, granulars, dusts, gel baits, aerosols, and bait stations — each formulation presents a different exposure profile, and the certified operator's PPE program should reflect that.

Liquid Concentrates

Liquid concentrates are the highest-exposure formulation in routine structural and L&O work. The product is being handled at full registered concentration, mixed and loaded into application equipment, and any spill or splash exposes the handler to the most concentrated form of the product. Standard PPE for liquid concentrate handling on most structural labels:

  • Chemical-resistant gloves of a label-specified material category — typically nitrile or barrier-laminate, in a thickness sufficient for the product. Single-use exam-grade gloves are not adequate for concentrate handling on most structural labels; reusable nitrile gloves with documented chemical resistance to the product are.
  • Long-sleeved shirt and long pants, with chemical-resistant apron during mixing and loading.
  • Chemical splash goggles — not safety glasses with side shields, not face shields alone. Splash goggles seal against the face and prevent liquid entry from the side.
  • Chemical-resistant footwear with closed toes — rubber or specifically labeled chemical-resistant boots, not canvas or leather work shoes.
  • Respirator where the label requires it; otherwise mix outdoors or in well-ventilated areas to minimize inhalation exposure.

Ready-to-Use Liquid and Aerosol

RTU products and aerosol cans are pre-diluted and present lower per-handling exposure than concentrates. Many RTU labels require only long sleeves, long pants, gloves, and eye protection. That said, repeated daily use of even low-concentration products produces cumulative exposure, and the operator who uses RTU aerosol thirty times a day for ten years is wise to wear the same PPE regardless of label minimums. Aerosols also create inhalation exposure — work in ventilated areas and avoid prolonged spraying in confined spaces without respiratory protection.

Granulars

Granular formulations have low dermal exposure during application — the product is in solid form and does not splash — but they generate dust during pouring, loading, and broadcast spreading. PPE focuses on protecting against dust inhalation and ingestion: long sleeves, long pants, gloves to handle the product, and a NIOSH-approved dust mask (N95 minimum) for prolonged loading or for any operation that visibly generates dust. Some granular product labels specifically require a particulate respirator during loading.

Dusts

Insecticidal dusts — boric acid, silica aerogel, diatomaceous earth, and various active-ingredient dusts — produce fine particulate that is readily inhaled and that lingers airborne in confined spaces. Dust applications in attics, wall voids, and crawlspaces are among the higher-respiratory-exposure applications structural operators perform. Standard practice:

  • NIOSH-approved respirator — at minimum an N95 for benign dusts in well-ventilated spaces; an elastomeric half-face or full-face respirator with P100 particulate cartridges for confined-space and prolonged work.
  • Eye protection — sealed goggles, especially in attics where overhead application puts dust directly into the face.
  • Long sleeves and pants, gloves, and a dust-resistant cap or hood for attic work.
  • Skin coverage above and beyond the bare minimum — Florida attics in summer combine extreme heat with concentrated dust exposure, and the temptation to strip down is exactly counter to PPE discipline.

Gel Baits and Bait Stations

Gel baits and pre-loaded bait stations are the lowest-exposure structural formulation in routine use. The product is in a controlled matrix, applied in tiny placements, and not aerosolized. Standard PPE for gel bait application is gloves and eye protection at minimum, with hand-washing after application. Most labels do not require specialized PPE for gel placement, but the certified operator should still ensure the technician is not eating, drinking, or smoking with bait residue on their hands — a routine source of accidental ingestion exposure.

Fumigants

Fumigation is its own license category and is regulated separately under both Chapter 482 and the federal label of each fumigant. Sulfuryl fluoride, aluminum and magnesium phosphide, and similar fumigants carry highly specific PPE, monitoring, posting, and aeration requirements that go far beyond routine structural PPE. Certified operators who hold a Fumigation category license complete additional training and follow product-specific Applicator Manuals (typically incorporated by reference into the label) for every job. This course does not attempt to summarize fumigation safety in a paragraph — the point for the Core operator is to know that fumigation is qualitatively different and that any operator without a current Fumigation category certification is not permitted to perform fumigation work, full stop.

Respiratory Protection Program

If any product applied by your business requires respiratory protection on its label — and most structural businesses use at least one such product — Chapter 482 and OSHA require that you operate a written respiratory protection program that meets the requirements of OSHA 29 CFR 1910.134. The program elements that FDACS inspectors and OSHA inspectors both look for:

  • Written program on file at the licensed business location, identifying the respirators used, the products that require them, and the program administrator (typically the certified operator).
  • Medical evaluation for every employee required to wear a respirator. The evaluation is performed by a physician or other licensed healthcare professional and confirms the employee can wear a respirator without medical contraindication. This is required before fit-testing.
  • Fit-testing annually (qualitative or quantitative depending on respirator type) for each respirator model the employee may wear. Fit-test records must be retained.
  • Training on respirator selection, donning and doffing, seal checks, cartridge change schedules, cleaning, and storage. Documented and dated.
  • Cartridge change schedule — documented and based on either manufacturer service-life data, end-of-service-life indicators, or a reasonable change-out frequency. "Change cartridges when you can smell the chemical" is not an acceptable schedule.
  • Cleaning, inspection, and storage procedures for shared or individually assigned respirators.

Facial hair is a frequent failure point: a beard or significant facial stubble breaks the seal between the respirator and the face and is non-compliant under OSHA. Employees required to wear tight-fitting respirators must be clean-shaven where the respirator seals — there is no exception for stylistic preference, and no respirator passes a fit-test on a beard.

KEY STATUTE — Documented Respirator Program

Operating without a written respiratory protection program when label-required respirator use is occurring is a triple exposure: it is an OSHA violation, it is a Chapter 482 / Rule 5E-14 issue (failure to use label-required PPE properly), and in the event of a worker injury claim, it is direct evidence in any tort or workers' compensation proceeding. The certified operator who has the program in place — written program, medical evaluations, current fit-test records, training documentation, cartridge change records — has done the legal and ethical work. The certified operator who relies on "we always wear them" without documentation has not.

Spill Response

Every truck performing pesticide application work in Florida should carry a spill kit appropriate to the products it transports. A workable structural spill kit includes:

  • Absorbent material — granular vermiculite, kitty litter, or a commercial spill absorbent — sufficient to absorb the largest container in the truck.
  • Heavy-gauge contractor trash bags for collecting absorbed material.
  • A shovel or scoop dedicated to spill response (not a tool that goes back into general use).
  • Gloves, splash goggles, and chemical-resistant overshoes appropriate for the products carried.
  • Emergency contact card with: company emergency number, certified operator phone, CHEMTREC (1-800-424-9300), Florida Poison Information Center (1-800-222-1222), and the local fire department non-emergency number.
  • SDS sheets for every product on the truck.

The standard spill response sequence is the "three Cs" — Control, Contain, Clean Up:

  1. Control — stop the source of the spill. Set the leaking container upright, close the valve, plug the puncture. Move people and pets away from the area. Don't rush in without PPE.
  2. Contain — keep the spill from spreading and especially from reaching any drain, waterway, or storm sewer. Build a berm of absorbent material around the spill perimeter. If the spill is on a hard surface near a drain, block the drain first.
  3. Clean Up — apply absorbent over the spill, allow it to take up the liquid, sweep into a contractor bag, label the bag with the product identity and date, and dispose of according to label and Florida hazardous-waste rules.

Hosing a spill down with water is wrong almost every time. Water spreads the product, carries it toward drains and groundwater, and destroys any opportunity to contain and absorb cleanly. The first impulse on any spill should be PPE on, then absorbent on. The water hose stays where it is.

COMMON VIOLATION — Spill Down a Storm Drain

The single most consequential field error in pesticide handling is allowing a spill to reach a storm drain. Storm drains in Florida discharge directly to surface waters in most jurisdictions — there is no treatment between the parking lot drain and the canal, lake, or estuary. A pesticide spill that reaches a storm drain is simultaneously a Chapter 482 violation, a federal Clean Water Act violation, and a Florida Department of Environmental Protection enforcement matter. The certified operator who can demonstrate that a spill was contained before reaching a drain has dramatically smaller exposure than one whose technician hosed the parking lot down. Block storm drains first, then deal with the spill.

First Aid for Pesticide Exposure

Every pesticide label includes a First Aid or Statement of Practical Treatment section. This section is product-specific and is the definitive guide to first response for that product. The certified operator's job is to ensure that technicians know where to find this section on the label, that the SDS for every product is accessible in the truck, and that the basic first-aid responses are in muscle memory:

  • Eye exposure — flush eyes with clean water for at least 15 to 20 minutes, holding eyelids open. Remove contact lenses after the first few minutes if easily removable. Continue flushing while transporting to medical care for any product where the label specifies it.
  • Skin exposure — remove contaminated clothing immediately. Wash the affected skin with soap and water for 15 to 20 minutes. Do not use solvents or harsh cleaners. Bag the contaminated clothing for laundering separately or for disposal.
  • Inhalation exposure — move the affected person to fresh air immediately. If breathing has stopped, perform CPR as trained. Call 911 and Poison Control.
  • Ingestion exposure — call Poison Control (1-800-222-1222) immediately. Do not induce vomiting unless the label specifically directs it; many pesticide formulations cause more harm being vomited than being absorbed.

The Florida Poison Information Center at 1-800-222-1222 is staffed 24/7 by toxicologists who can assess product-specific exposure and direct appropriate care. They have access to the same active-ingredient toxicology data that emergency-room physicians may not. Calling Poison Control is the right move on any significant exposure, and the call itself is part of your incident response record.

Exposure Incident Recordkeeping

When a worker or customer exposure incident occurs, the certified operator's documentation responsibility expands. A complete exposure-incident file includes:

  • Date, time, and location of the incident.
  • Product identity — brand name and EPA registration number — and the specific application context (mixing, applying, post-application contact).
  • Identity of exposed person(s) — employee name and position, or customer name and contact information.
  • Description of exposure — route (dermal, ocular, inhalation, ingestion), estimated duration, estimated quantity if known.
  • Symptoms reported and timeline of symptom development.
  • First aid administered and by whom.
  • Medical care sought — facility, provider, treatment, and outcome.
  • Calls made — to Poison Control, to 911, to the company emergency contact, to the certified operator.
  • Follow-up actions — investigation findings, corrective actions, retraining, equipment changes.

This file should be created within 24 hours of the incident and retained for the duration relevant to potential workers' compensation claims, OSHA recordkeeping, and any subsequent FDACS investigation — typically at least five years. OSHA 300 logs and 301 incident reports may also apply depending on injury severity.

FDACS Notification Triggers

Several incident types trigger a notification obligation to FDACS or to other Florida regulators. The certified operator should know these in advance, not look them up after an incident:

  • Worker injury or illness requiring medical treatment beyond first aid, related to pesticide exposure — generally reportable under OSHA, and depending on circumstances may also be reported to FDACS as a pesticide-related incident.
  • Customer exposure causing illness or injury — almost always becomes an FDACS complaint matter once the customer files; the certified operator's first move should be to report the incident to FDACS proactively rather than wait for the complaint.
  • Significant pesticide spill reaching surface water, groundwater, or a storm drain — reportable to the Florida Department of Environmental Protection's State Warning Point at 1-800-320-0519 and to local emergency response.
  • Pesticide release exceeding the federal Reportable Quantity for any listed substance (CERCLA / EPCRA) — reportable to the National Response Center at 1-800-424-8802.
  • Suspected misapplication causing damage to a third-party property (drift, contamination, plant injury, structural staining) — investigate, document, and report to insurance and to FDACS as appropriate.
  • Pesticide theft — report to local law enforcement and to FDACS, particularly for restricted-use pesticides.

Self-reporting an incident to FDACS is almost always the better path than waiting for the regulator to find out from a complaint. Florida's enforcement disposition reflects this: a certified operator who proactively reports an incident, documents the response, and demonstrates corrective action is treated very differently than one who concealed the same facts and was discovered later. The statute does not give amnesty for self-reporting, but the practical pattern in administrative dispositions is clear.

COMPLIANCE PRACTICE — The Incident Drill

Once a year, the certified operator should run a tabletop incident drill with each crew. Pick a realistic scenario — a half-gallon termiticide concentrate spill in a customer's driveway, a technician with a chemical splash to the eye, a customer who calls reporting a child in the room during an indoor application — and walk the crew through the response. Who calls whom? Where is the SDS? What's in the spill kit? Where is the eye-wash? Where is the documentation form? Twenty minutes once a year of structured drill produces dramatically better real-incident response than reading the policy on the day of the event. The certified operator who can document this drill — agenda, attendees, scenario, debrief — has both compliance evidence and a meaningfully more prepared crew.

Tying It All Back Together

This four-lesson Core course began with the structure of Chapter 482 — license categories, the certified operator's professional responsibility, FDACS enforcement authority. It moved through the records and contracts that document compliance. It examined the pesticide label as the legal document at the center of every application. And it closed on PPE, respiratory protection, and incident response as the practical implementation of the label's requirements.

The unifying theme across all four lessons is that the certified operator carries individual professional responsibility for everything that happens under their license. That responsibility is exercised through systems: training systems, documentation systems, supervisory systems, response systems. The systems are not glamorous and they consume time that could otherwise be spent on revenue work. They are also the difference between a license that supports a thirty-year career and a license that ends in a consent order. Build the systems early, maintain them honestly, and the statute that governs Florida structural pest control becomes a framework you operate inside rather than a hazard you keep tripping over.
