Terms of Service

1. Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the PestEd website, online courses, AI tutor, and related services (collectively, the “Services”), which are operated by PestEd (“PestEd,” “we,” “us,” or “our”). By creating an account, enrolling in a course, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Eligibility

The Services are intended for licensed pest control applicators and technicians in the State of Florida who are at least 18 years of age. By using the Services, you represent and warrant that you meet these requirements and that the personal and professional information you provide (including your name, address, date of birth, and license number) is accurate, complete, and your own.

3. Account Registration and Security

Student accounts on PestEd are passwordless by design. Your email address is your identity on the platform. To sign back in to an in-progress course or your account after your session ends, visit /login, enter the email you used at enrollment, and we will send a one-time sign-in link to that address. Each link is good for fifteen (15) minutes and can be used only once.

You are responsible for maintaining the security of the email account associated with your PestEd account, for all activities that occur under your account, and for keeping your contact information current. You agree to notify us promptly of any unauthorized use of your account or the associated email. We are not liable for any loss or damage arising from your failure to safeguard your account or your email.

4. Course Enrollment and Access

Enrollment in a PestEd course grants you a personal, non-transferable, non-exclusive license to access that course's content and to receive a certificate of completion upon satisfying all completion requirements (including minimum seat time and quiz passing score). Each course license is for one individual; sharing of credentials, quiz answers, or course content is strictly prohibited.

5. Quiz Integrity and Continuing Education Compliance

You agree that you will personally complete each course's reading and quiz, that you will not share, sell, or distribute quiz questions or answers, and that the information you provide on the FDACS-13325 attendance form (or any other regulatory form) is true and correct. PestEd reserves the right to invalidate certificates and notify the Florida Department of Agriculture and Consumer Services (“FDACS”) if it determines that course completion requirements were not met in good faith.

6. Intellectual Property

All course content, materials, software, and trademarks displayed on the Services are the property of PestEd or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any portion of the Services without our prior written consent.

7. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to the Services or to any account or system.
  • Use automated means (bots, scrapers, etc.) to access the Services.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Reverse engineer or attempt to extract the source code of any PestEd software.
  • Use the Services to harass, defame, or impersonate any person or entity.

8. Payments and Refunds

Course fees are stated at the point of purchase. Payments are processed by Stripe, Inc. PestEd does not store credit card numbers on its servers. Refunds are governed by our Refund Policy, which is incorporated by reference into these Terms.

9. Continuing Education Credit Disclaimer

PestEd is a registered Florida continuing education provider. PestEd makes reasonable efforts to ensure that course content reflects current FDACS requirements and that completion records are submitted in accordance with applicable rules. However:

  • PestEd does not guarantee that any specific course will be accepted toward your license renewal in every case. FDACS retains final authority over credit acceptance.
  • You are solely responsible for verifying that your continuing education credit has been properly applied to your license record with FDACS.
  • Course content is provided for educational purposes only and does not constitute legal advice or binding FDACS interpretation. For binding regulatory guidance, contact FDACS at (850) 617-7997.

10. AI Tutor Disclaimer

PestEd offers an artificial-intelligence study assistant (“AI Tutor”) to help users understand course content. The AI Tutor may produce inaccurate or incomplete information. You should not rely on the AI Tutor for legal, regulatory, or compliance decisions. Always verify regulatory information with the official statute, rule, or FDACS directly.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PESTED DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PESTED DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PESTED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF PESTED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PESTED'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO PESTED IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

13. Indemnification

You agree to defend, indemnify, and hold harmless PestEd and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Services, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) the inaccuracy of any information you provide.

14. Modification of Terms

We may modify these Terms at any time. Material changes will be communicated by email or by a prominent notice on the Services. Your continued use of the Services after a change takes effect constitutes acceptance of the modified Terms.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Services will immediately cease.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Services shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
